Alliance for Sustainable Energy, LLC (Alliance) Documents

Prime Contract - Contact No. DE-AC36-08GO28308 effective July 29, 2008, between the Alliance for Sustainable Energy, LLC and the U.S. Department Of Energy for the management and operation of the National Renewable Energy Laboratory.

The basic contract DE-AC36-08GO28308 between the Department of Energy (DOE) and the Alliance for Sustainable Energy LLC (Alliance) (M000) was signed July 29, 2008. Shortly after award, the parties determined that the existing contract DE-AC36-99GO10337 between DOE and the Midwest Research Institute (MRI) would be terminated effective September 30, 2008, in order to allow Alliance to begin full management and operating activities on October 1, 2008. A complete copy of the current contract DE-AC36-08GO28308 between DOE and Alliance is posted below (M002), incorporating the revised start dates as well as other administrative changes. Modification A001, a funding modification, made no administrative changes to the contract and is not posted here. A separate copy of Modification M002, which identifies the specific changes mad, is also individually posted below.

Energy Savings Performance Contracts (ESPCs)

Energy Savings Performance Contracts (ESPCs) allow Federal agencies to accomplish energy savings projects without up-front capital costs and without special Congressional appropriations. See 42 U.S.C. § 8287, et seq.

Although the DOE Golden Field Office (Golden) awards and administers DOE’s Indefinite Delivery Indefinite Quantity (IDIQ) ESPCs, these “master umbrella contracts” establish only a broad statement of work and allow Federal agencies to issue ESPC delivery orders and/or task orders under them. Golden does not generally maintain copies of site-specific ESPC delivery orders, task orders, or modifications.

Rather, the Federal agency offices that award delivery and/or task orders under DOE’s IDIQ ESPC contracts are responsible for negotiating their terms and conditions and making any necessary payments to the contractor. Additionally, these Federal agency offices are responsible for maintaining a master copy of their delivery and/or task orders, as well as all associated modifications or deliverables. It is therefore our recommendation that FOIA requests for contracts covering specific ESPC projects be submitted to the particular site-specific agency.
